The Terms of Sale stated on this page
apply to all GiftBasket.com orders including but not limited to orders
received by phone, email, fax, online, spreadsheet files, in person, in
store, etc.

Parcel Carrier Failure |
|
If a parcel carrier such as UPS, FedEx,
DHL, or U.S. Postal Service fails to deliver your gift basket on time
due to bad or
adverse weather conditions including snow, UPS, FedEx, and DHL do
not offer shipping refunds.
Thus, we are also unable to offer shipping refunds for late
deliveries caused by adverse weather conditions.
If a parcel carrier
such as UPS, FedEx, DHL, or U.S. Postal Service fails to deliver your
gift basket on time, except in the case of an act of God (including bad
weather), an act of war, or high seasonal shipping volumes such as
Christmas, then the incremental difference between Express delivery
(Next Business Day, 2nd Business Day, or 3rd Business Day) and Ground
Delivery will be refunded provided you have paid for a Express Delivery
upgrade. If you paid for Ground Delivery, then no refunds will be
given. |

Substitutions |

GiftBasket.com, LLC
reserves the right to substitute any and all components in a basket or
set, including but not limited to food items, non-food items, baskets,
containers, ribbons, colors, and any and all other components with items
of comparable value at any time for any reason without notice and
without any discount or refund to the buyer or recipient. We may also
substitute a completely different gift basket of comparable value at any
time for any reason without notice and without any discount or refund to
the buyer or recipient. The product photos shown are only representative
of what may be delivered. You or your gift recipient may not receive a
gift basket or gift set that looks like the one shown due to your choice
of size and options, or the availability of food items, non-food items,
baskets, containers, ribbons, etc. from suppliers, or Substitutions as
discussed above or for any other reason at any time without notice and
without discount or refund.
Due to warm temperatures
during the summer months, some chocolate items in our gift baskets may
be replaced with non-chocolate
items of equal value. |

Online Ordering:

To order from GiftBasket.com, you must use
a valid credit card. We accept Visa, MasterCard, American Express
and Discover. The GiftBasket.com Web
site uses a secure order processing system to ensure your order
information is confidential and secure. The industry standard Secure Sockets
Layer (SSL) assures that your credit card number is encrypted prior to
transmission over the Internet.
Once you place your order, you will receive two emails from us.
The
first is a credit card receipt and the second is an order confirmation.
If you do not receive two emails, then it means that you didn't
successfully complete the online ordering process and your order may be
delayed and/or not ship. If you do not receive two emails from us
when ordering, then you are responsible for contacting us to confirm
your order status at 1-800-785-0955. When contacting GiftBasket.com
about your order, please have your 10-digit invoice number, as shown on
your order confirmation and credit card receipt, available to expedite
your inquiry. |

Returns and Exchanges |
You have our promise to always do what is
fair.
Address Corrections
and Fees
You are responsible for providing an accurate and complete
recipient shipping address including:
- Recipient Name(s)
- Company Name (if applicable)
- Street Number and Street Name
- Floor, Suite, or Apartment Number
(if applicable)
- Zip Code
If you are unsure of any part of a
delivery address, we encourage you to verify the address with your
recipient before you place your order.
If
you, UPS, FedEx, DHL, U.S. Mail or any other courier requests a
corrected or more complete address or makes a correction to the
address you provided after we ship your gift basket, then there is a
$25.00 fee per gift basket. Please avoid this fee by providing an
accurate and complete address when you place your order.
If UPS, FedEx,
DHL, U.S. Mail or other courier returns your gift basket to us as
undeliverable, you then have the option of re-shipping the same
basket to a new address and paying the $25 incorrect address fee
plus a new shipping charge, or receiving a credit for 50% of the
price of the gift basket (we have a 50% restocking fee). The
original shipping charge is non-refundable.
Carrier Failure
If a parcel
carrier such as UPS, FedEx, DHL, or U.S. Postal Service fails to
deliver your gift basket on time, except in the case of an act of
God (including bad weather), an act of war, or high seasonal
shipping volumes such as Christmas, then the incremental difference
between Express delivery (Next Business Day, 2nd Business Day, or
3rd Business Day) and Ground Delivery will be refunded provided you
have paid for a Express Delivery upgrade. If you paid for Ground
Delivery, then no refunds will be given.
Customer Satisfaction
If you are not
satisfied with the gift basket you ordered, please call us to
discuss your feedback. In some limited situations, you may be
eligible to return or exchange your gift basket with our
pre-approved Return Authorization Number (RAN).
You must call and request your return or
exchange and RAN within 3 days of receiving the gift basket that you
want to return.
If your request for a return or exchange
with RAN is granted, then you have the opportunity to return to us
at your own expense the complete, original, unused,
unopened gift basket in its original shipping carton with all
original contents and packaging with the Return Authorization
Number. When we receive your returned gift basket with pre-approved
RAN and if it meets the requirements above, then we will issue a
credit of 50% of the price of the gift basket (we have a 50%
restocking fee). The original shipping charge is
non-refundable.
Corporate, Large, and
Special Orders
Gift baskets ordered as part of corporate orders,
large orders, multiple orders, special orders, custom gift basket
orders, special discounts, etc., are not normally eligible for
returns, exchanges, or any credit or refunds. Fresh-baked
items returned to us due to customer/recipient address error
and/or non-response to our requests for address correction, are
not eligible for any credit or refunds as the fresh-baked goods
must be destroyed.

Custom Gift Baskets Because we create custom gift baskets uniquely for your order,

Please count only business days, Monday through
Friday. Exclude Saturdays, Sundays, and all holidays that fall on business days.
For example, if you place an order before the daily 12:00 Noon PST deadline on a
Thursday, and select 2nd Business Day, your order will ship on Thursday and be
delivered on Monday. However, if that Monday is a holiday, your order will be
delivered on Tuesday. For questions about shipping and delivery dates, see the
